On September 26, 2008 a federal district court judge found that an Orlando law restricting sharing food in public parks violated the rights of two groups who share food with homeless individuals.

Victory for Hawaii's Homeless Children
Back to School

In October 2007, Lawyers for Equal Justice, the American Civil Liberties Union Foundation and the law firm of Alston, Hunt, Floyd & Ing, with technical assistance from NLCHP, filed a class action lawsuit, Kaleuati v. Tonda, on behalf of all homeless children in Hawaii seeking to ensure access to education. The recent settlement in this case protects the education rights of homeless children.

Victory for VOCA and VAWA!

The Senate CJS (Commerce, Justice, Science, and Related Agencies) Appropriations Committee passed a $15 million dollar increase to VAWA (Violence Against Women Act) funding and increased the VOCA (Victims of Crime Act) cap by $45 million, which will enable states to fund significantly more services.

Fresno Homeless Residents Win Settlement
City Destroyed Personal Property

$2 Million Judgment for Unlawful Seizure Unprecedented FRESNO United States District Judge Oliver W. Wanger gave preliminary approval today to a $2.35 million dollar class-action settlement between a class of hundreds of homeless Fresno residents and the City of Fresno and the California Department of Transportation. The court had already determined that Fresno's practice of immediately seizing and destroying the personal possessions of homeless residents violates the constitutional right of every person to be free from unreasonable search and seizure. The homeless plaintiffs in the lawsuit, Kincaid v. Fresno, were represented by a team of attorneys from the American Civil Liberties Union of Northern California (ACLU-NC), the Lawyers Committee for Civil Rights (LCCR) and the law firm of Heller Ehrman LLP. In 2006, NLCHP filed an affidavit in the Fresno case, providing protocols that ensure homeless persons' rights are properly respected and that connect homeless persons with outreach workers and services. NLCHP applauds Judge Wanger's decision.

U.N. Special Rapporteur Visits
Maps America, Noting Dramatic Link between Race and Poverty

After a three-week tour of the U.S. with a number of stops with housing and homelessness advocates coordinated by NLCHP, U.N. Special Rapporteur, Mr. Doudou Diène stated that he had witnessed the resegregation of America. He commented that he could visibly see two maps of the U.S.: "The map of social and economic marginalization is tightly coinciding with the ethnic map. The communities most marginalized socially, economically and politically are the historically discriminated minorities." He concluded that this disturbing trend calls for immediate rectification.

President's Budget Slashes Homeless Funding
2009 Proposed Budget Includes Cuts to Range of Programs

President Bush this week released his Budget Request for the Fiscal Year 2009. The budget proposes significant cuts for many of the larger social safety net programs. Homeless programs fared slightly better, but proposed increases to homeless programs would be offset by larger cuts to other homeless or social safety net programs.

New Report to U.N. Describes Racially Discriminatory Impact of U.S. Housing Policy

African-Americans make up 12% of Americans but represent over 50% of homeless people. On December 10, International Human Rights Day, NLCHP and a coalition of over 50 organizations charged the U.S. with systemic discrimination against racial minorities by denying equal access to adequate housing.

On November 5, over 200 advocates gathered in Los Angeles, Minneapolis, Chicago, New Orleans, and Washington, DC for NLCHP's annual National Forum on the Human Right to Housing. Resolution Celebrates 20 Years of the Act and Calls on Congress to Do More

The U.S. House of Representatives passed a resolution recognizing the 20th anniversary of the McKinney-Vento Homeless Assistance Act and the need for Congress to do more to address homelessness. The resolution (H.Res. 561) was introduced by Reps. Christopher Shays (R-CT) and Maxine Waters (D-CA).

NLCHP Cites Ordinances Passed in Dallas, Las Vegas, and Orlando

On June 7, NLCHP Executive Director Maria Foscarinis gave testimony at an invitation only briefing on human rights issues in the U.S. with the U.N. High Commissioner on Human Rights. The entire U.N. delegation was shocked to learn about U.S. cities prohibiting or restricting charitable organizations and individuals from sharing food with homeless people.
