U.S. Department of Education Guidance on the McKinney-Vento Act
The guidance in this document replaces all prior nonregulatory guidance for the Education for Homeless Children and Youth program, reflecting changes made to the law by the 2001 amendments.
This
document provides an explanation and interpretation of requirements authorized
by the McKinney-Vento Act that affect the education of homeless children and
youth. It also provides guidance for
carrying out these requirements.
While
States may wish to consider the guidance in developing their own guidelines and
standards, they are free to develop alternative approaches that are consistent
with applicable Federal regulations.
Compliance
with this document, however, will be deemed by Department officials, including
the Inspector General, as compliance with the applicable Federal statutes and
regulations.
